The 24/7 Sobriety Program has been in operation in North Dakota since January 2008.
Participation in the 24/7 Sobriety Program may be ordered through the court as a condition of bond, pre-trial release, or as a condition of sentence or probation for any violation where drugs or alcohol may be involved, cases involving domestic abuse, or abuse/neglect of a child.
An individual may also get approval through the ND Department of Transportation to volunteer and participate in the 24/7 Sobriety Program in order to obtain a temporary restricted driver’s license (TRDL).
An individual who is arrested for a second or subsequent DUI is required as a condition of bond, to refrain from alcohol use and report to a specific law enforcement location to be placed in the 24/7 Sobriety Program for alcohol testing. If the individual fails a test, he or she is immediately taken into custody. If the arrestee fails to show for testing it is considered a violation, and bond may be revoked.
It is the individual's responsibility to pay for the testing fees when participating in the 24/7 Sobriety Program. These fees include:
PBT (Breath test) - $1.00 per test ($2.00 per day).
SCRAM (Bracelet) - $135 due when installed and $6.00 per day monitoring fee.
Drug Patch - $60.00 per patch.
U/A (Urinalysis) - $5.00 per test and $25.00 for laboratory confirmation.
